1. Acceptance of terms

By downloading, installing or using DeskPulse (“the Software”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software.

2. License

DeskPulse is open-source software distributed under the MIT License. You are granted a non-exclusive, worldwide, royalty-free license to use, copy, modify and distribute the Software, subject to the following conditions:

• The copyright notice and permission notice shall be included in all copies or substantial portions of the Software
• The Software is provided “as is”, without warranty of any kind

3. Use of the Software

You may use DeskPulse for any lawful purpose. You agree not to use the Software:

• For any unlawful purpose or in violation of any laws
• To transmit malicious code or interfere with the operation of the Software
• To attempt to gain unauthorized access to any systems or networks
• In any way that could damage, disable or impair the Software

4. Disclaimer of warranties

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

DeskPulse displays cryptocurrency prices for informational purposes only. We do not guarantee the accuracy, completeness or timeliness of the price data. The Software should not be used as the sole basis for making investment decisions.

5. Limitation of liability

IN NO EVENT SHALL PATTU TIWARI, QWF GROUP LLC, OR THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

6. No investment advice

DeskPulse is a price-tracking tool only. Nothing in the Software constitutes investment, financial, legal or tax advice. Cryptocurrency investments carry high risk; conduct your own research and consult qualified professionals before making investment decisions.

7. Third-party services

DeskPulse retrieves data from third-party services (CoinGecko, alternative.me and GitHub). We are not responsible for the accuracy, reliability or availability of these services. Your use of the Software may be subject to their terms.

8. Privacy

Your use of DeskPulse is also governed by our Privacy Policy. DeskPulse does not collect, store or transmit personal information.

9. Modifications to the Software

As open-source software, you are free to modify DeskPulse. Any modifications you make are your responsibility, and we are not liable for issues arising from modified versions.

10. Updates and changes

We may update the Software and these Terms from time to time. Continued use after changes constitutes acceptance of the new terms.

11. Termination

You may stop using DeskPulse at any time by uninstalling it. We reserve the right to modify or discontinue the Software at any time without notice.

12. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law provisions.
